S884-
1) Amends the current rape law from “any term of years”
to a mandatory 15 years.
2) Amends the law for repeat offenders raising the “15 year mandatory sentence”to a “30 years mandatory sentence” for repeat offenders.
3) Creates a Repeat Sex Offender Law. “Three Strikes You’re In”
Three convictions for any sex offense ranging from Lewd and Lascivious acts up to forcible rape. Carries a penalty of life imprisonment with NO PAROLE.
The Bill's are broken down into four bills: House 1389, 1388, 1390, and Senate Bill S884.
H.1389,1388 and 1390 are sponsored by Rep. Donald Wong (R-Saugus), House Minority Leader Bradley Jones (R-North Reading), David Torrisi (D-North Andover), and 20 others. S.884 is sponsored by Sen. Bruce Tarr (R-Gloucester), Sen. John Keenan (D-Quincy), and 26 others.
The New Laws Would:
> Make sex offenders ineligible for parole, requiring them to serve a 30-year mandatory sentence upon their first conviction of child rape;
> Require repeat sex offenders to serve a life sentence with no eligibility of parole.
> Require repeat sex offenders who are convicted of three sex offenses to serve a life sentence with no eligibility for parole. Because our Repeat Sex Offender Bill affects criminals convicted who have committed Lewd and Lascivious acts, Possession of child porn & Dissemination of child porn a child's testimony would be unnecessary in such cases. In cases of child rape the new law would give additonal tools for the prosecution.

Repeat sex offenders cannot be rehabilitated.
Sex offenders are 4.5 times more likely than other criminals to be re-arrested for sexual assault.
The average sentence for convicted rapists was 11 years, while the actual time served was 5.
According to the Massachusetts Children's Trust Fund, The average pedophile will victimize 244 children in their lifetime. Habitual sex offenders predictably pose the greatest risk of re-offending and their repeated crimes are entirely preventable.
.Public safety, public opinion, and common sense demand that the worst of the worst be kept locked. It is our duty to protect the children at any cost.

Brian Addeo, Level 3 Sex Offender on Lifetime Parole. On March 11, 2011, Addeo, who was being monitored by a GPS tracking bracelet, cut off this bracelet in the Town of Tewksbury and remains at large for 5 days. Addeo has been convicted of Kidnapping, Unnatural Rape of a Child Under 16 (4 counts), Aggravated Rape (2 counts), Indecent Assault & Battery on a Child (4 counts), Indecent Exposure (4 counts) & Assault & Battery with a Dangerous Weapon (Knife) in Worcester Superior Court. These convictions stem from 3 separate incidents involving 6 female victims in Massachusetts. Brian Addeo should have never been released from prison.

Alvin Fields Jr. Level 3 sex offender
In 2005 Fields was convicted of for statutory rape of a 13-year old- and sentenced to just 2 years in jail as part of a plea deal – The original charge was forcible rape of a child. Fields has been arrested numerous times for exposing himself and has been in and out of jail for 20 years. He was most recently arrested for failure to register as a sex offender on January 18th 2011

Kerry V Bell- Worcester, Ma Level 3 sex offender
In 07 Bell was convicted of attempted rape and offering to engage in sex for a fee. He was sentenced to 4-5 years in jail for the attempted rape and a 1-year concurrent jail term for attempting to engage in sex for a fee. The SJC reversed his attempted rape conviction after finding the evidence was insufficient to support the conviction.
Bell also has a 1987 conviction in Nevada for attempted sexual assault, failing to register as a sex offender and two counts of possession of child pornography. He is on probation until 2016 when he will turn 70. As part of his probation Bell was ordered to undergo sex offender counseling and submit to GPS monitoring and have his computer randomly searched by his probation officer. He was found guilty of failing to register as a sex offender when he moved from Texas in 2002, then moved to Shrewsbury in 2004. He recently plead guilty to possession of child porn June 3rd 2010 and was sentenced to just 4 ½ to 5 years.

Corey Saunders- Level 3 Sex offender
In 2001 Saunders was convicted of attempted rape of a child and indecent assault and battery on a child under 14. He spent just 4 years in prison before Judge Moses rejected a motion to hold Sauders as sexually dangerous person and released him back into the community. Former ADA Paul Walsh Jr. said Saunders was one of the 10 most dangerous sex offenders he has ever prosecuted in his 16 years of public service. Judge Richard Moses released Saunders even though prosecutors said he was likely to strike again. On Jan 30th 2008 Saunders was arrested for rape of a child with force, indecent assault and battery on a child under 14 and enticing a child. At the time Saunders was serving 4 years of probation for the attempted rape of a 7-year old boy.

William Redmon, Level 3 Sex Offender
Redmon was convicted of indecent assault and battery on a person 14 or over on Feb. 3, 1994, and eight counts of indecent assault and battery on a child under 14 on Jan. 2, 1992.
His most recent arrest was at his home on March 3, 2009. The case involved 14-year-old Leominster girl who said Mr. Redmon assaulted her when she was 5 or 6 years old until she was 8. The girl “stated that he had been doing things to her from the time she was 5-6 years old up until she turned 8,” She went on to describe many instances of “Bill” touching her body over and under her clothes.
Police asked the girl’s mother about Mr. Redmon, and the woman “stated she knew Mr. Redmon was a level 3 sex offender but did not know what that meant until recently,” He was charged with three counts of rape of a child with force, five counts of indecent assault and battery on a child under 14 and one count of a subsequent offense of indecent assault and battery on a child.

John Tobia, level 3 sex offender
Tobia has a history of indecent behavior in public dating back to June of 1987. Tobia admitted to violations of the probation he received for his conviction in two 2001 cases for exposing himself, one in Springfield and one in Westfield. He was convicted on charges of open and gross lewdness and lascivious behavior. The Judge imposed the two-year sentence recommended by the court's Probation Department and Assistant District Attorney. While on probation in Massachusetts and Connecticut Tobia traveled without permission to Colorado, where he was arrested on Oct. 11, 2007, for indecent exposure and forgery. The Colorado case involved Tobia performing a sexual act on himself in front of two pre-school-aged children in the electronics department of a Kmart store. On Dec. 18, 2009 Tobia was convicted in Holyoke District Court of lewd and lascivious behavior and sentenced to sixmonths in jail for performing a sexual act on himself in front of a woman in a supermarket and following her to her car. Tobia has been convicted over 10 times for open and gross lewdness, indecent exposure or indecent assault and battery on a child.

Elias Acevedo, Level 3 Sex Offender
In 1995, Acevedo was arrested in Puerto Rico for incest and sodomy and was also charged in 1990 with aggravated burglary. He was convicted in 1997 of raping a child and indecent assault and battery on a person over 14. On December 14th 2007 Acevedo was arrested in Aguadila, Puerto Rico, where he had been staying since he fled the country in May 2006. He was extradited to Massachusetts for his arraignment and was held on only $500,000 cash bail. In October of 2007, New Bedford police issued an arrest warrant for Mr. Acevedo after two young girls told investigators the defendant sexually assaulted them on several occasions in 2005 and 2006. The victims were 11 and 13 at the time of the alleged assaults. During two interviews with Sexual Assault Intervention Network investigators the girls said Acevedo had sexually assaulted them. One stated Acevedo assaulted her in July 2005. She said Acevedo raped her and attacked her on other occasions. The second girl stated Acevedo sexually assaulted her and threatened her with a knife, warning he would kill her and her family if she told anyone.
In April of 2009 Acevedo was convicted of charges of rape of a child with force and three counts of indecent assault and battery on a child under 14.
Following the three-day trial the Assistant District Attorney asked that Acevedo be sentenced to life in prison, yet Judge Richard Moses, sentenced Acevedo to 12 to 15 years. Upon his release, Acevedo will be placed on probation for 10 years. During that time, Acevedo must wear a GPS monitoring system, have no contact with children, stay away from the victims and any witnesses, and undergo sex offender counseling. Upon his release, Acevedo will be placed on probation for 10 years.

There is a Crisis in Massachusetts
Massachusetts ranks #1 for the highest rate of confirmed cases of child abuse and neglect in the country ~ U.S. Department of Health and Human Services.
The number of children in Massachusetts confirmed as abused or neglected during 2009 was 33,910 -
Massachusetts makes up nearly 30% of confirmed cases of abuse and neglect nationally.
The number of children in Massachusetts reported as abused and neglected In 2008 increased by a rate of 13 children per day.
The only way to truly prevent child predators from re-offending is to keep them imprisoned where they can no longer be a danger to children.
We need strong mandatory sentences to prevent the continued victimization of children.
